Selling a Henderson Rental Property Without Waiting for the Lease to End

Tired landlords, accidental landlords and owners with a tenant who has stopped paying all reach the same question: can I sell this place with someone still living in it? Often, yes.

Why Henderson owners decide to stop renting

Henderson has a lot of single-family rentals, many of them former primary homes that owners kept when they moved. Some were great investments for years. Then a major repair hits, the property manager changes, or the owner simply wants to stop taking calls about a broken AC in August. Others want to free up equity for a different investment or for retirement without waiting out a lease.

The accidental landlord

Plenty of landlords never planned to be one. They moved for work, inherited a parent's house, or could not sell when they wanted to. If the rental came from a relative, our page on selling a house you inherited in Henderson covers the estate side, and if you are leaving the area entirely, our guide to relocating away from Henderson may help with timing.

When the tenant situation is the problem

Late rent, wear and tear beyond normal, unauthorized occupants or an HOA complaint about the yard can make ownership exhausting. We buy occupied homes as-is, and we are not asking you to resolve every tenant issue before we make an offer. Worn carpet, scuffed walls and a neglected backyard are normal things for us to find in a long-term Henderson rental.

Nevada landlord-tenant basics to keep in mind

Residential tenancies in Nevada are largely governed by NRS Chapter 118A on landlords and tenants. We are not attorneys, the rules have exceptions, and your lease matters, so treat the following as a general orientation rather than advice.

Notice before entering for a walkthrough

Nevada law generally requires a landlord to give a tenant at least 24 hours' notice before entering, and to enter only at reasonable times, unless the tenant agrees otherwise. That applies to the walkthrough we need before making an offer, so we schedule around the tenant's routine and keep the visit short.

The lease and the security deposit

As a general rule, selling the house does not cancel an existing lease; the new owner typically steps into the landlord's role under the rental agreement. The statute also addresses the security deposit when a landlord's interest ends through a sale: the remaining deposit is generally transferred to the new owner and the tenant is notified in writing of the new landlord's contact information. Separately, when a tenancy ends, Nevada generally gives the landlord 30 days to return the deposit or provide an itemized accounting.

If you want the property vacant instead, ending a tenancy requires proper written notice, and the required notice depends on the type of tenancy and the reason. A Nevada landlord-tenant attorney or a licensed property manager is the right person to confirm the rules for your lease.

How we buy an occupied rental

  1. Send us the basics: the lease end date, current rent, deposit amount and whether the tenant is current.
  2. We schedule a walkthrough with proper notice to the tenant and keep it brief and respectful.
  3. You get a written offer on the property in its current condition, priced with the tenant in place.
  4. During escrow, rent and deposits are prorated or transferred according to the purchase agreement, and the tenant is notified of the new owner.

Because we expect the tenant to be there, we do not ask you to stage rooms, schedule open houses or coordinate repeated showings around someone else's work and family schedule. The rest of the process mirrors any other sale, and our description of how a cash sale closes covers escrow and title.

Rentals in HOA communities

Many Henderson rentals sit inside associations that have their own rules about leasing, such as minimum lease terms or tenant registration. Violations caused by a tenant usually land on the owner's account. If those fines are stacking up, our page on handling HOA violations at closing explains how they are generally settled. Rentals in Green Valley Ranch and in the 1990s neighborhoods of Whitney Ranch commonly fall under both a master association and a sub-association, which means two sets of rules to check. Before closing, ask the management company whether any leasing registration or tenant information form needs to be updated for the new owner.

Things to sort out before you list or sell

Find the signed lease and any renewals, the move-in condition report, the deposit ledger and any written notices you have sent. Those documents make escrow smoother and protect you if there is ever a dispute about the deposit. If the tenant has asked about buying the home or has a lease clause about a sale, mention it early. More answers on costs and timing are in our frequently asked questions about selling.

Telling your tenant about the sale

Tenants usually handle a sale better when they hear about it early and directly from you. Let them know the house is being sold, that their lease stays in effect, and that someone will reach out with new payment instructions after closing. Giving them a clear point of contact cuts down on rumors and anxious phone calls. If you use a property manager, decide together who delivers the news and how rent collected during escrow will be handled, so the tenant is never unsure where to send the next payment.

It is also worth gathering recent utility arrangements, HOA gate access details and any appliance warranties, since the next owner will need them to keep the tenancy running smoothly.

Before You Call

Must my tenants leave the Henderson house before you buy it?

No. We buy occupied rentals with the tenant and lease in place. In general, the lease continues after the sale and we become the landlord. If you would rather deliver the house vacant, that requires proper notice under Nevada law and your lease, so check with a landlord-tenant attorney or property manager first.

What happens to the tenant's security deposit when I sell?

Nevada law generally requires that, when a landlord's interest ends through a sale, the remaining deposit is transferred to the new owner and the tenant is notified in writing who the new landlord is. Escrow can handle the transfer as part of closing. Confirm the specifics with your escrow officer or an attorney.

Can you buy a rental where the tenant is behind on rent?

Yes. A tenant who is behind does not prevent a sale. We review the lease, how rent has been paid, and the shape the house is in, then account for it in the offer. How unpaid rent is handled at closing is something we agree on in writing before you sign.

How much notice does my tenant need before your walkthrough?

Nevada generally requires at least 24 hours' notice before a landlord enters a rental, with entry at reasonable times unless the tenant agrees otherwise. We coordinate around the tenant's schedule, keep the visit short, and are happy to go through your property manager if you use one.
